1. Acceptance of Terms

By accessing or using Cyla (“Service”) operated at cyla.in, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and customers in India and elsewhere, with the governing law being the laws of India.

2. Description of Service

Cyla provides a platform for industrial gas cylinder tracking, verification, compliance management, and related features. Public cylinder verification (e.g. at /audit or /c/[serial]) is offered for informational purposes. Full features are available to registered customers under separate commercial agreements.

3. Eligibility and Account

You must be at least 18 years old and have the authority to bind your organisation (if applicable) to use paid or registered features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information and comply with applicable laws including the Gas Cylinder Rules, 2016 and PESO regulations where relevant.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any Indian or applicable law.
• Attempt to gain unauthorised access to our systems, other accounts, or third-party data.
• Upload or transmit malicious code, or misuse or overload our infrastructure.
• Scrape, copy, or resell our data or Service in an unauthorised manner.
• Use the public verification feature to misrepresent the authenticity of cylinders or to circumvent compliance obligations.

We may suspend or terminate access for breach of these terms.

5. Intellectual Property

All content, software, trademarks, and materials on the Service are owned by us or our licensors. You may not copy, modify, or create derivative works without our prior written consent. You retain rights in the data you submit; you grant us a licence to use it to provide and improve the Service.

6. Disclaimers

The Service is provided “as is”. We do not guarantee uninterrupted or error-free operation. Public cylinder verification results are based on data provided by our customers and are for general information only; we do not warrant the accuracy or completeness of such data. You use the Service at your own risk. We are not liable for any indirect, incidental, or consequential damages to the extent permitted under Indian law.

7. Limitation of Liability

To the maximum extent permitted under the Indian Contract Act, 1872 and other applicable laws, our total liability for any claims arising from or related to the Service shall not exceed the fees paid by you for the Service in the twelve (12) months preceding the claim, or one thousand Indian Rupees (INR 1,000), whichever is higher.

8. Indemnity

You agree to indemnify and hold harmless Cyla, its affiliates, and their officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these terms, or your violation of any law or third-party rights.

9. Governing Law and Disputes

These terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at [insert city/state as per your preference, e.g. New Delhi]. Nothing in these terms affects your statutory rights under Indian consumer protection law where applicable.

10. Changes and Severability

We may modify these terms at any time. Continued use after posting of changes constitutes acceptance. If any provision is held invalid, the remaining provisions shall remain in effect.
